{"id":4686,"date":"2022-09-01T15:40:45","date_gmt":"2022-09-01T14:40:45","guid":{"rendered":"https:\/\/www.btsasociados.com\/?p=4686"},"modified":"2022-09-01T15:40:46","modified_gmt":"2022-09-01T14:40:46","slug":"reform-of-the-penal-code-punishing-theft-with-up-to-18-months-imprisonment-enters-into-force","status":"publish","type":"post","link":"https:\/\/www.btsasociados.com\/en\/reform-of-the-penal-code-punishing-theft-with-up-to-18-months-imprisonment-enters-into-force\/","title":{"rendered":"Reform of the Penal Code punishing theft with up to 18 months imprisonment enters into force"},"content":{"rendered":"\n<p>Next Monday, the <strong>reform<\/strong> of the <strong>Penal Code<\/strong> will come into force, which foresees prison sentences of up to 18 months for petty <strong>theft<\/strong> in the case of <strong>recidivism.<\/strong><\/p>\n\n\n\n<p>The reform is necessary because the previous regulation already foresaw an aggravated modality for <strong>recidivism in theft<\/strong>, according to the doctrine of the Supreme Court this was intended to punish thefts that <strong>exceed 400 \u20ac <\/strong>when they occur in a multi-recidivist manner.<\/p>\n\n\n\n<p><strong>Minor theft<\/strong> offences that are committed in a multi-recidivist manner do not have a sufficient penal response, despite the fact that they are crimes that are the object of growing concern as they directly affect not only <strong>tourism<\/strong>, <strong>commerce<\/strong> and the <strong>economy<\/strong> in general, but also the <strong>security of citizens themselves.<\/strong><\/p>\n\n\n\n<h3>Increased penalties for petty theft offences<\/h3>\n\n\n\n<p>In cases of petty <strong>theft or theft of less than 400<\/strong> <strong>\u20ac<\/strong>, the penalty is increased if the perpetrator is a multiple offender and the total amount of the stolen goods, including previously committed theft offences, exceeds 400 \u20ac.
